In execution of that certain Deed of Trust dated May 3, 1998, recorded in the Clerk’s Office of the Circuit Court of Page County, Virginia, in Deed Book 579, Page 583, securing a note in the original principal amount of ONE HUNDRED SEVENTY THOUSAND DOLLARS ($170,000.00), to Joseph V. Sottosanti and Pamela J. Sottosanti, from Charles A. Babel and Kathleen Ann Babel, default having been made in the payment of the debt therein secured, and being requested to do so by Noteholders, the undersigned Substitute Trustee, appointed by the Circuit Court of Page County, Virginia, by Court Order dated July 2, 2024, will offer for sale at public auction on the front steps of the Circuit Court of Page County, Virginia, located at 116 South Court Street#1, in the Town of Luray, Page County, Virginia, on

10:00 a.m.
All that certain tract or parcel of land situate, lying and being in the Town of Luray, Page County Virginia, containing 0.4625 acre, according to a survey and plat made thereof by John R. Hudson, Jr., C.L.S., dated September 18, 1978, LESS, HOWEVER, that certain parcel containing 7,653 square feet, conveyed by Deed recorded in Deed Book 413, Page 825, in the aforesaid Clerk’s Office, being currently identified on the tax map records of Page County as Tax Map #42A10-A-65, as containing .27 acre, improved by a large residential dwelling and a garage with a physical address of 333 West Main Street, Luray, Virginia.
Sale and conveyance shall be made subject to all existing easements and restrictive covenants as the same may lawfully affect said real estate, including a ten foot (10’) easement along the East side of the aforesaid real estate, set forth in the aforesaid Deed of Trust.
TERMS OF SALE: A bidder’s deposit of $10,000.00, in the form of a cashier’s check, will be required on the day of the sale. Settlement shall be made within thirty (30) days of the date of sale. Sale and conveyance shall be in gross and not by the acre. The property will be sold in an “AS IS” condition without inspections or warranties of any kind. Real Estate taxes shall be prorated to date of sale. Conveyance will be made by a Special Warranty Deed. It shall be the responsibility of the Purchaser to obtain possession of the real estate and to pay all recording fees except Grantor’s tax. The United States has a 120 day right of redemption pursuant to 18 USC Section 3613(C).
