TERMS OF SALE: Cash or, in the alternative, a down payment of not less than ten percent (10%) of the successful bid price, payable in cash or certified funds at the time of sale, with the balance due within forty-five (45) days of the Court’s approval of the sale. The successful bidder shall deposit the bid price or required down payment to the credit of the Clerk of the Circuit Court of Page County, Virginia. The Property shall be sold in gross and not by the acre, in its “AS IS, WHERE IS” condition as of the date of sale, without any warranty or representation of any kind, express or implied. The Property shall be sold subject to possible rights of parties and/or tenants in possession, encroachments, overlaps, overhangs, deficiency in quantity, all questions of boundaries, location, and acreage which a current and accurate survey would disclose, roadways, unrecorded easements, and any other matter which would be disclosed by an inspection of the premises and/or record title thereto. Real estate taxes and property owners’ association assessments shall be prorated as of the date of sale. All sales shall be subject to confirmation and approval by the Circuit Court of Page County, Virginia. The Special Commissioner reserves the right to continue, postpone, or withdraw the sale without further notice. Additional terms of sale may be announced at the sale.Time shall be of the essence with respect to settlement by the successful bidder. All costs of conveyance, which shall be by Special Warranty Deed, examination of title, recording fees, notary fees, settlement fees, and Grantor’s tax, to be at the cost of successful bidder.
