Sexual battery against minor, child abuse, assault on police officer among August indictments

LURAY, Aug. 2 — Members of a grand jury in Page County Circuit Court last week issued a true bill on a total of 64 indictments handed down Wednesday, August 2 on charges placed among 29 individuals.

Those indicted by the August 2 grand jury include:

• Tony Lee McNear, of Luray, Va., was indicted on three unclassified felonies for aggravated sexual battery of a victim under the age of 13 and one Class 6 felony for the same offense. Three of the charges are related to an offense that occurred on May 1, 2012, according to court records, with an arrest on Dec. 15, 2022. The fourth offense occurred on July 1, 2017, according to court records, with an arrest on Dec. 15, 2022. McNear is scheduled to appear in court again at 9 a.m. on Wednesday, Sept. 13 for a hearing.

Brian Lee Caplinger, of Bridgewater, Va., was indicted on a Class 6 felony for abduction by force or intimidation, a Class 5 felony for possession of a Schedule I/II drug, and a Class 1 misdemeanor for reckless driving. The abduction and reckless driving offenses occurred on Jan. 27, 2023, according to court records, with an arrest on Jan. 28, 2023. The drug possession offense and an arrest occurred on June 29, 2022, according to court records. Caplinger is scheduled to appear in court again at 9 a.m. on Wednesday, Oct. 11, 2023 for a four-hour trial.

Austin Michael Phillips, of Shenandoah, Va., was indicted on two Class 6 felonies (direct indictments) for assault on a law enforcement officer and a Class 1 misdemeanor for obstruction of justice/resisting arrest without force. All three offenses and an arrest occurred on July 27, 2022, according to court records. Those records did not list a future court date for Phillips at this time.

Timothy Ashley Short, of Luray, Va., was indicted on two Class 6 felonies for child abuse (disregard of life) and eluding or disregarding police, and a Class 1 misdemeanor for reckless driving (speeding in excess of 85 mph). All three offenses and an arrest occurred on Nov. 26, 2022, according to court records. Short is scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 23, 2023 for a hearing.

James Craig Waybright, of Rileyville, Va., was indicted on two Class 6 felonies for child abuse (disregard of life – direct indictment) and eluding or disregarding police (endanger), and two Class 1 misdemeanors for reckless driving (endangering life, limb and property) and obstructing justice (resisting arrest without force). All four offenses occurred on Sept. 7, 2021, according to court records, with an arrest on June 14, 2023. Waybright was scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 9 for a status hearing.

Amber Dawn Davis (a.k.a. Amber Dawn Wigington), Stanley, Va., was indicted on an unclassified felony for possession with intent to manufacture a Schedule I/II drug, a Class 5 felony for possession of a Schedule I/II drug, and two Class 6 felonies for possession of a gun while in possession of a Schedule I/II drug and non-violent felony possession of a gun (within 10 years). All four offenses and an arrest occurred on May 25, 2023, according to court records. Davis was scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 9, 2023 for a bond hearing.

Lora Kelly Lang, of Luray, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug, and three Class 6 felonies for credit card fraud (to merchant, more than $1,000), identity theft (financial loss greater than $1,000) and felony possession of a weapon (ammunition, not gun). The drug possession occurred on Feb. 23, 2023, according to court records, with an arrest on March 28, 2023. The credit card fraud and identity theft occurred on May 18, 2023, according to court records, with an arrest on May 23, 2023. The weapon offense and an arrest occurred on May 27, 2023. Lang is scheduled to appear in court again at 9 a.m. on Thursday, Sept. 7, 2023 for a hearing.

• John Wayne Presgraves, of Stanley, Va., was indicted on three unclassified felonies for the distribution or sale for profit of a Schedule I/II drug. All three offenses and an arrest occurred on Dec. 8, 2022, according to court records. Presgraves is scheduled to appear in court again at 9 a.m. on Thursday, Oct. 19, 2023 for a hearing. Presgraves is also scheduled for a one-day jury trial at 9 a.m. on Wednesday, Dec. 13, 2023.

• Heather Ann Doolan, of New Market, Va., was indicted on three Class 5 felonies for possession of a Schedule I/II drug, and two Class 1 misdemeanors for possession of a Schedule III drug and trespassing after being forbidden. All five offenses and an arrest occurred on Aug. 6, 2022, according to court records. Those records indicate that a subsequent arrest was made on Nov. 4, 2022, on two of the felony drug charges. Doolan is scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 23, 2023 for a status hearing.

• Marc Francis Cyphert, of Shenandoah, Va., was indicted on two Class 5 felonies for possession of a Schedule I/II drug, and two Class 1 misdemeanors for pettit larceny (less than $1,000 – not from person) and destruction of property with intent (less than $1,000 in value). One drug offense and an arrest occurred on Jan. 4, 2023, according to court records. The second felony drug offense and an arrest occurred on June 16, 2023, according to court records. The two misdemeanors occurred on Oct. 18, 2023, according to court records, with an arrest date of Jan. 4, 2023. Cyphert is scheduled to appear in court again at 9 a.m. on Thursday, Aug. 17 for a hearing.

• Jerry Lynn Hilliards, of Stanley, Va., was indicted on an unclassified felony for the manufacture or distribution of a Schedule I/II drug (third or subsequent offense), and two Class 1 misdemeanors for pettit larceny (less than $1,000 – not from person) and trespassing after being forbidden. All three offenses occurred on Oct. 21, 2021, according to court records, with an arrest on Oct. 22, 2021. Hilliards is scheduled to appear in court again at 1:30 p.m. on Wednesday, Aug. 23, 2023 for a hearing.

• Charles William Pearson, of Luray, Va., was indicted on an unclassified felony for the distribution of methamphetamines (more than 10 grams), a Class 6 felony for failure to register as a violent sex offender, and a Class 1 misdemeanor for unauthorized possession of drug paraphernalia. The sex offender registry offense occurred on March 22, 2023, according to court records, with an arrest on March 29, 2023. The two drug offenses and an arrest occurred on March 25, 2023, according to court records. Pearson is scheduled to appear in court again on the sex offender registry charge at 9 a.m. on Monday, Oct. 2, 2023 for a jury trial. On the two drug offenses, Pearson is scheduled to return to court at 9 a.m. on Wednesday, Nov. 8, 2023 for a jury trial.

• Eric Michael Fletcher, of Shenandoah, Va., was indicted on a Class 5 felony for entering a structure to commit assault and battery, and a Class 6 felony for the destruction of property (monument). Both offenses and an arrest occurred on June 8, 2023, according to court records. Fletcher is scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 30, 2023 for a status hearing.

• Bryan Michael Bond, of Stanley, Va., was indicted on Class 5 felony for the possession of a Schedule I/II drug and an unclassified misdemeanor for driving while intoxicated (second in 5-10 years). The drug offense occurred on May 18, 2023, according to court records, with an arrest on May 23, 2023. The DWI occurred on March 19, 20223, according to court records, with no arrest listed. Bond is scheduled to appear in court again at 9 a.m. on Thursday, Sept. 21, 2023 for a hearing.

• Justin Lee Stillwill, of Luray, Va., was indicted on two Class 5 felonies for possession of a Schedule I/II drug. One offense and an arrest occurred on Jan. 7, 2023, according to court records, while the second offense and an arrest occurred on April 18, 2023. Stillwill was scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 9, 2023 for a hearing.

• Bobby Joe Shifflett, of Stanley, Va., was indicted on a Class 6 felony for third or subsequent driving while intoxicated (DWI) offense, and a Class 1 misdemeanor for a second DWI. The second DWI offense and an arrest occurred on March 30, 2023, according to court records, with the third DWI offense and an arrest occurring just over a month later on May 1, 2023. Shifflett is scheduled to appear in court again at 9 a.m. on Monday, Aug. 14, 2023 for a hearing.

• Daniel Louis Moneymaker, of Luray, Va., was indicted on a Class 5 felony for a second registry violation (failing to register as a Tier III sex offender). The offense occurred on April 21, 2023, according to court records, with an arrest on May 17, 2023. Moneymaker is scheduled to appear in court again at 9 a.m. on Wednesday, Sept. 13, 2023 for a hearing.

• Jeremy Scott Jones, of Stanley, Va., was indicted on a Class 5 felony for making a false statement on a criminal history consent form. The offense occurred on March 21, 2023, according to court records, with an arrest on May 3, 2023. Jones is scheduled to appear in court again at 1:30 p.m. on Wednesday, Aug. 23 for a hearing.

• Charles Clayton Bradley, of Stanley, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on Dec. 29, 2022, according to court records. Bradley is scheduled to appear in court again at 9 a.m. on Wednesday, Sept. 6, 2023 for a hearing.

• Clinton Matthew Burton, (no address listed), was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on Jan. 24, 2023, according to court records. Burton is scheduled to appear in court again at 9 a.m. on Thursday, Sept. 21, 2023 for a hearing.

• Amy Renee Cook, of Stanley, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense occurred on Feb. 4, 2023, according to court records, with an arrest on March 19, 2023. Cook is scheduled to appear in court again at 9 a.m. on Thursday, Sept. 7, 2023 for a hearing.

• Megan Nichole Dean, of Stanley, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on May 5, 2023, according to court records. Dean is scheduled to appear in court again at 9 a.m. on Wednesday, Sept. 13, 2023 for a hearing.

• Ross Alan Jenkins, of Stanley, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on July 26, 2022, according to court records. Jenkins is scheduled to appear in court again at 9 a.m. on Thursday, Sept. 7, 2023 for a hearing.

• Anthony Scott Presgraves, of Luray, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on March 4, 2023, according to court records. Presgraves is scheduled to appear in court again at 9 a.m. on Wednesday, Sept. 13, 2023 for a hearing.

• Brandon Michael Richards, of Luray, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense occurred on Jan. 8, 2023, according to court records, with an arrest on Jan. 12, 2023. Richards is scheduled to appear in court again at 9 a.m. on Wednesday, Sept. 6, 2023 for a hearing.

• Brittany Grace Stokes, of Stanley, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on Jan. 8, 2023, according to court records. Stokes entered a guilty plea on Aug. 3 and was sentenced to three years in prison, with three years suspended, as well as three years of supervised probation.

• Richard Willis Wright, of Luray, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense occurred on Sept. 7, 2022, according to court records, with an arrest on Sept. 8, 2022. Wright is scheduled to appear in court again at 1:30 p.m. on Wednesday, Aug. 23, 2023 for a hearing.

• Kevin John McCoy, of Stanley, Va., was indicted on a Class 6 felony for violent felon possession or transporting of a weapon. The offense and an arrest occurred on Feb. 28, 2023. McCoy is scheduled to appear in court again at 9 a.m. on Monday, Dec. 4, 2023 for a jury trial.

• Chelsey Dawn Goode, of Stanley, Va., was indicted on a Class 1 misdemeanor for unauthorized distribution of drug paraphernalia. The offense and an arrest occurred on Jan. 8, 2023, according to court records. Goode is scheduled to appear in court again at 9 a.m. on Monday, Aug. 28, 2023 for a trial.

Grand jury hearings are held the first Wednesday of each month in Page County Circuit Court.
