Catalytic converter theft, abduction and assault charges among April indictments

LURAY, April 3 — Members of a grand jury in Page County Circuit Court issued a true bill on a total of 29 indictments handed down Wednesday, April 3 on charges placed among 19 individuals.

Those indicted by the April 3 grand jury include:

• Gary Franklin Freed Jr., of Luray, Va., was indicted on a Class 5 felony for abduction by force or intimidation, a Class 6 felony for felony weapon possession (ammunition, not a gun), a Class 1 misdemeanor for the assault and battery of a family member, and a Class 1 misdemeanor for damaging a phone line to prevent a 911 call. The felony weapon charge was nolle prosequi (effectively dismissed, or “not processed”) during a hearing on April 3. All charges and an arrest occurred on Dec. 7, 2023, according to court records. Freed is scheduled to appear in court again at 9 a.m. on Wednesday, April 10 for a bond hearing on the three remaining indictments.

John William Higgs, of Front Royal, Va., was indicted on four counts of damaging catalytic converters, including two Class 6 felonies and two unclassified felonies (all charges had the same description, despite different classifications). Two charges occurred on Aug. 5, 2022, according to court records, with an arrest on Dec. 20, 2023. The other two charges occurred on Dec. 23, 2022, according to court records, with an arrest on Dec. 20, 2023. Higgs is scheduled to be in court again at 9 a.m. on Monday, April 22, 2024 for a hearing.

Michael Jon Wawrzyniec, of Elkton, Va., was indicted on a Class 4 felony for maliciously shooting or throwing an object at a vehicle. The offense occurred on Oct. 14, 2023, according to court records, with an arrest on Nov. 2, 2023. Wawrzyniec is scheduled to appear in court again at 9 a.m. on Wednesday, Aug. 14, 2024 for a one-day jury trial.

Bryan Elijah-Juan Kirby, of Lexington, Va., was indicted on two unclassified felonies for the distribution or more than 100 grams of methamphetamine and more than 200 grams “mix”, and a Class 6 felony for child abuse (disregard for life). One drug offense occurred on Oct. 17, 2023, according to court records, while all other offenses and an arrest occurred on Oct. 26, 2023. Kirby is scheduled to appear in court again at 9 a.m. on Wednesday, July 31, 2024 for a one-day jury trial.

Zacharee Isaiah Smith, of Luray, Va., was indicted on a Class 5 felony for the possession of Schedule I/II drug, and a Class 1 misdemeanor for pettit larceny of less than $1,000 (not from person). The larceny offense occurred on Jan. 16, 2024, according to court records, while the drug offense and an arrest occurred on Jan. 17, 2024. Smith is scheduled to appear in court again at 9 a.m. on Wednesday, April 24, 2024 for a hearing.

David Carter Smith, of Stanley, Va., was indicted on a Class 5 felony for possession of child pornography (second or subsequent offense). The offense occurred on Dec. 26, 2022, according to court records, with an arrest on Sept. 28, 2023. Smith is scheduled to appear in court again at 9 a.m. on Wednesday, June 26, 2024 to enter a plea.

Robert Scott Smith Sr., of Luray, Va., was indicted on a Class 6 felony for child abuse (disregard for life). The offense occurred on Jan. 15, 2023, according to court records, with an arrest on Feb. 16, 2024. Smith is scheduled to appear in court again at 9 a.m. on Thursday, May 2, 2024 for a hearing.

• Nathaniel William Sours, of Rileyville, Va., was indicted on an unclassified felony for the manufacturing or distribution of a Schedule I/II drug (third or subsequent offense). The offense and an arrest occurred on Dec. 18, 2023, according to court records. Sours is scheduled to appear in court again at 9 a.m. on Thursday, April 11, 2024 for further proceedings.

• Robert Wayne Long, of Stanley, Va., was indicted on an unclassified felony for possession with intent to manufacture a Schedule I/II drug. The offense and an arrest occurred on Jan. 11, 2024. Long is scheduled to appear in court again at 9 a.m. on Wednesday, May 22, 2024 for a hearing.

• Derek Scott Jenkins, of Luray, Va., was indicted on a Class 6 felony for destruction of property with intent valued at more than $1,000. The offense occurred on Dec. 9, 2022, according to court records, with no arrest date listed. Jenkins is scheduled to appear in court again at 9 a.m. on Wednesday, April 24, 2024 for a hearing.

• Jay W. Funk, of Shenandoah, Va., was indicted on a Class 6 felony for non-violent felony possession of a gun within 10 years of being convicted of a felony. The offense and an arrest occurred on Jan. 28, 2024, according to court records. Funk is scheduled to appear in court again at 9 a.m. on Thursday, May 2, 2024 for a hearing.

• Allen Keith Comer, of Shenandoah, Va., was indicted on two Class 5 felonies for the possession of a Schedule I/II drug. The first offense occurred on Nov. 30, 2023, according to court records, with an arrest on Dec. 1, 2023. The second offense and an arrest occurred on Dec. 5, 2023, according to court records. Comer is scheduled to appear in court again at 9 a.m. on Thursday, May 2, 2024 for a hearing.

• Carl Lewis Cubbage Jr., of Stanley, Va., was indicted on a Class 5 felony for the possession of a Schedule I/II drug. The offense and an arrest occurred on Sept. 5, 2023, according to court records. Cubbage is scheduled to appear in court again at 9 a.m. on Thursday, May 23, 2024 to enter a plea.

• Joshua Delaney Debolt, of Luray, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense and an arrest occurred on March 24, 2024, according to court records. Debolt is scheduled to appear in court again at 9 a.m. on Wednesday, May 22, 2024 for a hearing.

• Joel Robert Miller, of Luray, Va., was indicted on a Class 5 felony for possession of a Schedule I/II drug. The offense occurred on April 29, 2023, according to court records, with an arrest on Nov. 6, 2023. Miller is scheduled to appear in court again at 9 a.m. on Wednesday, May 8, 2024 for a hearing.

• William Barry Phipps, of Shenandoah, Va., was indicted on a Class 5 felony for the possession of a Schedule I/II drug. The offense occurred on Dec. 21, 2023, according to court records, with an arrest on Jan. 26, 2024. Phipps is scheduled to appear in court again at 9 a.m. on Wednesday, May 22, 2024 for a hearing.

Shane Aaron Price, of Shenandoah, Va., was indicted on a Class 5 felony for the possession of a Schedule I/II drug. The offense occurred on Jan. 10, 2024, according to court records, with an arrest on Jan. 11, 2024. Price is scheduled to appear in court again at 1:30 p.m. on Wednesday, May 1, 2024 for a hearing.

Mariah Colby Dawn Richards, of Luray, Va., was indicted on a Class 5 felony for the possession of a Schedule I/II drug. The offense occurred on Oct. 8, 2023, according to court records, with an arrest on Nov. 24, 2023. Richards is scheduled to appear in court again at 9 a.m. on Monday, April 22, 2024 for a hearing.

Jennifer Denise Wright, of Stanley, Va., was indicted on a Class 5 felony for the possession of a Schedule I/II drug. The offense occurred on Jan. 12, 2024, according to court records, with an arrest on Jan. 22, 2024. Wright is scheduled to appear in court again at 9 a.m. on Wednesday, April 10, 2024 for a hearing.

Grand jury hearings are held the first Wednesday of each month in Page County Circuit Court.
